BOARD POLICY


In order to comply with Utah law, Child Abuse or Neglect Reporting Requirements Utah Code §62A-4a-403(1) and Child Abuse and Neglect Reporting by School Personnel R277-401, it is the policy of
the North Sanpete School District Board of Education that any school employee that has reason to believe that a child's health or welfare has been or appears to have been harmed as
a result of abuse, neglect or trafficking, shall personally report consistent with the
procedures herein adopted.

  • School employees are immune from any civil and/or criminal
    liability when reporting in good faith suspected child abuse, neglect or trafficking.
  • Failure on the part of
    any school employee to report may result in legal, professional and/or district disciplinary action against the employee.
  • Consistent with R277-401-3(4), the School District shall annually notify all employees of their individual reporting responsibility under this policy and Utah law.


ADDITIONAL INFORMATION AND GUIDANCE


  1. School district staff is required to report all suspected cases of child abuse and neglect as soon as possible.
  2. It is NOT the responsibility of the school employee to:
  3. Prove that the child has been abused or neglected.
  4. Determine whether the child is in need of
  5. Determine who may be the abuser.
  6. In gathering information, any personal interview or physical examination of the child should
    be minimal and conducted in the highest professional manner. School employees shall not make contact with
    the child's family or other persons (relatives, friends, neighbors, etc.) for the purpose of
    determining the source or cause of the injury and/or apparent neglect.
  7. School personnel should refer to the possible signs and symptoms of abuse, neglect or trafficking attached
    to this policy for help in determining if the child may have been abused or neglected.
  8. If a school employee has reason to believe that a child has been abused or neglected or if the employee suspects trafficking, he/she shall immediately make a report to law enforcement or the Division of Child and Family Services (DCFS). The school employee shall also report both the employee’s reason to believe and that the report was made to the school principal or
  9. The principal shall notify the Superintendent immediately upon a report of suspected child
  10. The Superintendent shall notify the school nurse who will be the liaison person with the respective city, county and state agencies.
  11. The child abuse/neglect or trafficking reporting form as presented by the district shall be used.
